Terms of Service

These terms govern your use of the website and services of Talitha AI Solutions, a sole proprietorship operating from India (“Talitha”, “we”, “us”). By using our website or services you agree to them. If you use the service on behalf of a business, you confirm you can bind that business.

1. The service

Talitha lets businesses create an AI assistant for WhatsApp that answers customer questions using the business's own information, collects leads and booking requests, and lets the business's team take over conversations. Some features may be in development or available by early access, and may change.

2. Your account and responsibilities

• Provide accurate information and keep your login details secure.
• You are responsible for the content you upload (FAQs, documents, website content) and for the information your bot gives to customers. You must have the right to use that content.
• You are responsible for having a lawful basis, such as consent where required, to message your customers and to process their data.
• You must comply with the WhatsApp Business Terms and Meta's policies, including its messaging and commerce policies. Your WhatsApp access can be limited or removed by Meta independently of us.

3. Acceptable use

You must not use the service for anything unlawful, deceptive or harmful, including spam, harassment, fraud, impersonation, illegal goods or services, malware, or attempts to access other businesses' data or disrupt the service. We may suspend or end accounts that breach these terms.

4. AI-generated replies

The bot uses AI and may occasionally produce incorrect or incomplete answers. You should review and test your bot before launch and use the human takeover tools for sensitive matters. The bot is not a substitute for professional medical, legal or financial advice.

5. Fees and billing

Paid plans are billed on a subscription basis as shown at sign-up, including your chosen message allowance and optional skills. WhatsApp / Meta or other provider messaging charges and applicable taxes are additional. You can cancel any time; cancellation takes effect at the end of the current billing period unless we state otherwise. Prices are in Indian Rupees unless stated, may exclude GST and other taxes, and may change with notice. Payments are processed by third-party payment providers.

6. Intellectual property

You keep ownership of your content. You give us permission to use it to operate the service for you. We and our licensors own the platform, software and branding.

7. Privacy

Our Privacy Policy explains how information is handled.

8. Availability and disclaimers

We work to keep the service available but provide it “as is” without guarantees of uninterrupted or error-free operation. The service depends on third parties such as Meta and AI providers, whose outages or changes are outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Talitha is not liable for indirect or consequential losses, loss of profit or data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

10. Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms or to comply with law. On termination we will handle your data as described in the Privacy Policy.

11. Changes and governing law

We may update these terms and will change the “Last updated” date when we do. These terms are governed by the laws of India, and the courts of competent jurisdiction in India will have jurisdiction over any dispute, unless applicable consumer law says otherwise.
